A Welfare Benefits case has been granted permission to appeal to the Court of Appeal in a case concerning the rights of migrant workers to claim Employment and Support Allowance [C3/2014/0321].

The Appellant argues that Employment and Support Allowance (ESA) is a benefit 'intended to facilitate access to the labour market' and therefore that it cannot lawfully be withheld from an EEA jobseeker.

The case will now proceed to a full hearing at the Court of Appeal in mid 2015. The Appellant is represented by GCN’s Tom Royston instructed by Howells LLP .
