SSHD failure to apply own policy guidance when assessing credibility of Victim of Trafficking

FK, R (on the application of) v Secretary of State for the Home Department [2016] EWHC 56 (Admin)

In a recent judgment handed down by the Administrative Court (QBD), it was held that the Home Secretary's refusal to recognise the claimant as a victim of trafficking for lack of credibility would be quashed as the defendant had failed to apply her own policy contained in "Victims of human trafficking – Competent Authority Guidance" in relation to consistency and delay in disclosure.

Camille Warren appeared for the claimant, instructed by Paragon Law
