SSHD failure to apply own policy guidance to Victim of Trafficking

In R (on the application of) FK v Secretary of State for the Home Department [2016] EWHC 56 (Admin), in which Garden Court North Chambers’ Camille Warren appeared for the Claimant, it was held that the Home Secretary’s refusal to recognise the claimant as a victim of trafficking for lack of credibility would be quashed as the defendant had failed to apply her own policy contained in “Victims of human trafficking – Competent Authority Guidance” in relation to consistency and delay in disclosure.
