Judicial review settled after Tasaddat Hussain secures permission to challenge refusal of initial claim for vulnerable client

Garden Court North’s Tasaddat Hussain has secured permission for his client (‘RAK’) to challenge the Home Office’s refusal of his initial claim for asylum, settling a judicial review with the Secretary of State for the Home Department [‘SSHD’].

RAK is a vulnerable client, who fled Iraqi Kurdistan (IKR) to seek asylum in the UK. RAK has been politically active, interacting with social media posts and attending protests against human rights violations and corruption. He would likely face persecution for such activities upon return to IKR.

Upper Tribunal Judge Blundell granted permission to challenge the refusal on 3 February 2026. The Secretary of State for the Home Department (‘SSHD’) stated on 6 March that she had agreed to reconsider her decision to refuse on 29 November 2024, and to treat RAK’s submissions made on 17 September 2024 as a fresh claim. The SSHD will make a fresh decision within three months.

The SSHD has also agreed to pay the RAK’s reasonable costs for this judicial review claim, to be assessed if not agreed.
