Alexa Thompson secures dismissal of possession claim brought against disabled grandfather and his family

Garden Court North’s Alexa Thompson has successfully secured the dismissal of a possession claim brought by a private landlord against a disabled grandfather and his family.
Her client lived at the property with his children and grandchildren, all of whom would have been evicted if the Claimant’s Section 21 ‘no fault’ possession claim had succeeded.
At trial, the tenant defended the claim on the basis that the Claimant had failed to provide prescribed information about the tenancy deposit, the correct version of the How to Rent Guide, and the Energy Performance Certificate (EPC). These are all key safety and legal documents which landlords are required to provide to tenants.
The Claimant also failed to produce any documentary evidence that they provided the full tenancy deposit prescribed information, contrary to the requirements of s.213(5) Housing Act 2004, nor was this included in the trial bundle.
Following discussions, the Claimant agreed to discontinue their claim, and the court dismissed the claim with no order as to costs.
